What happens to unclaimed money in Swiss banks

Despite popular opinion, it’s quite frequent that there is no communication between clients and their banks for a long time. If the bank was not able to contact the customer for at least 10 years, such an account becomes the status of a so-called dormant account.

Many clients are banking in Switzerland because of the highest level of client confidentiality. Clients who appreciate confidentiality have signed a so-called hold-mail agreement. Based on a hold-mail agreement, the bank will keep the correspondence with the bank. To increase the level of secrecy, the bank is not allowed to send letters to the client.

After 10 years without contact with the customer, the bank has to inform the Swiss Banking Ombudsman that they are managing a dormant account. They have to demonstrate reasonable efforts to restore contact with the client.

After 10 years without communication, the Swiss Banking Ombudsman will be responsible for dormant accounts. They can remain dormant for the next 50 years because the dormant accounts are not published. The publication will take place after being 50 years under the management by the Swiss Banking Ombudsman – and not before. If there is no successor who claims the assets, after 60 years, the assets go to the Swiss government.

Before starting the research, you have to demonstrate your title to the assets in the account, including safe deposit boxes. A safe deposit box is just an integrative part of the account relationship between the client and his bank.

How can it be that there are thousands of bank accounts that contain millions in assets that are simply lying fallow? In many cases, it’s a matter of untaxed, clandestine, unreported income. Such unreported income is kept off the official company balance sheet and transferred to Switzerland. Cases involving bank accounts with unreported income almost always involve an agreement concerning with simple hold of mail at the bank. The correspondence remains in the bank. This specifies that the bank is not to send any mail to the actual address of the account holder. Such special agreements are entered into to make the work of tax investigators more difficult. These are also referred to as “poste restante” or “hold mail” agreements.

However, the bank will not give you any information if you cannot provide identification that establishes you as a legitimate successor.
