Risk Management
Van Lanschot Kempen’s business activities are exposed to risks. Risk management supports the clients, other stakeholders and the front office in ensuring that the risks incurred are controlled and conform with the legal requirements and the risk appetite. The main risks are the credit risk, the market risk, the operational risk, the settlement risk, the CVA (credit value adjustment) risk, the strategic risk, the interest rate risk, the liquidity riks, the securitization risk, the compliance risk, and the financial reporting risk.
Van Lanschot Kempen aims to have a transparent and simple balance sheet. Lending activities occur mainly in the private banking segment. The Executive Board prepares each year the risk appetite statement which translates the risk appetite into strategic limits. The Supervisory Board reviews the development of the risk profile twice a year.
The risk management framework identifies and analyses the risks at an early stage. The risks are mitigated and monitored, and adequate internal reporting systems and control procedures are the key elements of the risk management framework.
The risk management framework is based on three lines of defense principles; day-to-day responsibility for risk control lies with the front office, the first line of defense; Compliance, Group Risk Management and Finance, Reporting & Control form the second line of defense; Group Audit forms the third line of defense and is responsible for performing independent audits on the risk framework.

We are a fully independent boutique law firm. That’s why we don’t have any cooperation agreements with the banks.
Few banks do not disclose their Annual Reports to the public. Therefore, we collected reliable information on a best-efforts basis. We renounced to collecting information from unreliable sources. Until today, Swiss law does not impose the duty of publication to the banks as it is the case in the EU. Therefore, for a few banks, the information from the annual reports was not summarized and published.
There are some smaller banks without a rating. It makes no sense for them to apply for a rating because they are not involved in the lending business. If the bank has no rating, it’s not automatically a negative point. There are excellent private banks without a rating.
